Survey:The Death Penalty
Recently there as been much furore in India over the fate of ‘Afzal Guru’, who is due to be hung for masterminding the 2001 attack on Indian Parliament.
What is your view on capital punishment? Do you agree that governments are right to use the death penalty for punishing certain heinous crimes? Or do you think that capital punishment has no place in a humane society?

If india wants to prove it’s a country of rule of law
then it must hang Afzal Guru. If it does not hang Afzal
then it is sending a message anything goes in India, and
you can get away with it.
Stand up for what is right. It is unfortunate a disloyal
traitrous foreign woman is ruling illegally. Hindu cowards
standing and watching helpless.

Death sentence is not justified in a case, where there is a doubt about the perpetrator of the crime, because there is a chance you may be killing an innocent. It can be pardoned if there is a genuine remorse on the part of the perpetrator.
But in cases like afzal’s, it is heinous not to carry out the death sentence. None ever doubts he is the perpetrator and he, and his fellow murderers, take pride in their crimes. If let go, they will carry out more murders. If he is left in jail, his fellow murderers will try to release him by force and taht will only increase the crime.

To prtect innocent civilians I believe death penality is a necessity.

How does a Country prove to its Citizens that it can provide law and order and also protect them when the Government is not taking any positive action on a Judgement from the Highest Court of the Country.
Why does the President of India have to THINK about it, its a clear case and no thinking necessary.
Ask the people whose loved ones have died instead of the President, if the perprators of such crimes should be hanged or not.
Ministers from Kashmir are shouting that all India will be on fire, these people must be arrested also, since they are actually making threats against India itself.

The Government of India should not make an exceptional decision in any case after the judgement has been given.
For the longer term, they should consider removing capital punishment on the grounds that nobody has a right to take a life. It also takes care of any error of judgement. However, the person should be given appropriate punishment in any case. There is no reason to be soft.

This extreme punishment is questionable.
First, the human being - anybody one - need be improved to the better stage of the existence, in next lives also. The deliquent needs reparation, melioration, leadership for his mind and education to better accordance his Atman with Brahman. Because any attack to parliement or people is very not a meaningful act. Any premature finishing of the life may not be useful for his next melioration.
Second, a judgment may happend be worse, and tis is wors for an innocent people.
Third, it may be useful giving any distinct impuls and message for all community, crime delicts need be punished.
Than, I means, a strong punishment, but mot mortal is needed for this hardly reparable people.

those who commit crime should have equal punishment. Sometimes i feel, some of the Muslims nations are better where crime is dealt with strictly. Death penalty is a must for those who commit ghory crime.

We all society need constructing a new character of prisoners.
New born being follows his interest from the past life and will continue his recent acts. He shall be occupied and attracted the same sphere of recent activities and interests. Without a change of mind, he will be a follower of his self acts in new life only. Thus, we can meet a new born terrorist after his growing through the childhood, but it is a delayed new opportunity, may be only postponed for a period of new childhood time.
May be, he will be attracted to the same (or similar) sphere of his friends, can meeting old friends which are survived him and meeting him a new in a stage of a child, rather learning him a new realization the some old crime activities.
Thus, he need look into a learning the karma for to understand, no act can be done without the consequence to himself.
The time needed for a change of the mind and the reconstruction of his character, too are long probably for several years. Look the case of Hebrew activist Saul from Tarsus, at his conversion at the Damascus City, he need ten years spend in the south dessert Arabia for be a ´new being´

Guru is lucky, he had 5 years. He should have been hanged. India and England seems to have gone VERY soft in handling terorist.

A rule not executed is not a rule. A rule executed without jury is not justice. A king that allows the enemies of the state to spoil the state is a failed king. But of course the complexity is in when to be hard and when to be soft. It should not be a decision reached easily for the prsident of any nation to execute a death warrant even when warranted.

Certain points should be noted:
(1) Afjal got no defence lawyer.
(2) There is no direct evidence against him.
(3) He was a part of the Indian security service in Kashmir.
(4) He was arrested before in Kashmir, forced to be a surrendered militant, which he was not, by the security service in Kashmir. There are a lot of corruption in the armed forces in Kashmir which you cannot ignore.
(5) There was judicial enquiry who has organized that attack on Indian parliament: Pakistan or George Fernandez
If the government hang him the truth will be hanged along with him. The issue is that in the case Afzal Guru justice was not done.Son of Gilani, one of the most dreaful Harriyat leader was released because his father is rich( with money coming from Pakistan) and he can afford Jethmalani( A Hindutva man and a former minister in the BJP government) as his lawyer.
Afzal Guru is a poor Kashmiri Muslim, picked up by the police who has manufactured lies after lies to release everyone connected to the Harriyat but to blame this innocent( until proved guilty) man, whose only crime was that some of the dead terrorists( we do not know whether they are terrorists or not) phoned him in his mobile phone, which was in the custody of the police after his arrest.In any other court in any developed country, this type of evidence will be dismissed as fabricated, but in India very idle judges accepted these submission from the police uncritically, as Afzal has no lawyer, he could not counter argue these fabricated evidences.
There was no investigation who has organized the terrorist attack on Parliament. There are reports of a large number of fake attacks in both Kashmir and in the north Eastern states. In every country of the world, it is a common practice for the corrupt politicians and officers to start a war or to create war-like situation because then one can steal any amounts from the tax payers money. George Fernandez and some other people from the BJP( Jaswant Sinha, Souri, son-in-law of Vajpayee, D.P. Yadav, Mahajan) are some of the most corrupt people in India. The arms dealers Nanda and Chowdhury have admitted recently that they gave more than Rs.1 crore as bribe to the girl-friend ( Jaya Jetley) of Fernandez. It is quite possible that BJP leaders and Fernandez in particular have organized this attack on the parliament to steal as much money as possible from the government by creating a war-like situation imediately afterwards. Mahajan and his private secretary are already murdered(not by Kashmiri terrorists but by hit squads). There should be a proper independent investigation, only after that Afzal, if proven guilty by a new set of edidence, should be hanged.
It is the BJP leaders who want to hang Afzal rather than having a new independent investigation because they can then supress all evidences of their wanton theft from the tax payers money and bribes. If this evidence of the police, that the dead terrorists had contacts with Afzal, is enough to hang Afzal Guru, then Savarkar( the hero of the Hindutva) also should have been hanged because Nathuram Godse had contacts with him before and after Nathuran killed Mahatma Gandhi.
The case of Afzal is important for any poor Indian, because he/she can be picked up by the police and can be either killed immediately or killed later by the judges accepting fabricated evidence from the police.
This is also important for any Asian in Britain or USA. You can be picked up by the police and can have life sentence( in Britain) or you have to sit on an electric chair ( in USA) just for buying fruits from a Pakistani grocer shop. Police can very well create fale evidence that you have contacts with Arabs or Pakistanis and as a result you should get death sentence. This is the exact case for Afzal.

British Police can very well create fake evidence that you have contacts with Arabs or Pakistanis and as a result you should get death sentence. This is the exact case for Afzal.
